Overview

Certain business conduct is prohibited under the Trade Practices Act 1974 (TPA). The TPA has two main parts, this course covers only Part V of the TPA, the Consumer Protection provisions. These provisions exist to protect the rights of consumers, and ensure fair competition is maintained. This course is essential for all consumers, and goods and service providers in Australia.

This course covers the provisions that prohibit misleading and deceptive conduct, and those that prohibit false or misleading representations. Specific examples include whether silence is considered misleading, what environmental claims are allowable, what is considered to be misleading advertising, and what are considered to be false representations in regards to employment, and country of origin.


Objectives

Using everyday language and real-world examples, this program is adapted from materials and experiences of the ACCC and from leading cases, and aims to build a general awareness of your obligations under the law. At the successful completion of this course, you will be able to:

- State the main objectives of the TPA and the role of the ACCC
- Understand the Consumer Protection Provisions of the TPA, including deceptive or misleading conduct, and false or misleading representations
- List the penalties and other remedies applicable to a breach of the Consumer Protection Provisions of the TPA
